CONVEYANCING

WILLS
A Will is an important document that should not be put off. It provides security to your loved ones and does not take up much of your time. A minor cost now can help avoid greater Estate expenses later on in the administration of your Estate, avoiding family tensions that can arise more easily when a person dies intestate (without a Will), and of course peace of mind that your Estate will be distributed in accordance with your wishes.

POWERS OF ATTORNEY
There are two types:
A General (financial) Power of Attorney is a legal document which allows someone (chosen by you) to take control of your financial/personal affairs ONLY when and if you become unable to do so yourself.
A Medical Power of Attorney is a legal document which allows someone (chosen by you) to make decisions about your medical treatment ONLY when and if you become unable to do so yourself.
If they are not in place, they can cause great difficulty and expense as a VCAT order would need to be obtained by a loved one in order for them to make important decisions regarding your affairs.

DIVORCE/SEPARATION
Parenting arrangements: organising this is important for your children and their priorities and needs must be prioritised. We can assist you in putting an agreement in place.
Property/Financial Settlement: this entails the division of assets and liabilities of the relationship. The preferred and most cost effective approach is resolving your property settlement by reaching an agreement and signing a document called a Binding Financial Agreement. If it is a matter that cannot be resolved by agreement and the parties are not amicable, then the matter can be resolved by a Court Order.
Divorce: we can assist you in obtaining Court approval for your Divorce and attending the Court hearing if it is required in your circumstances.

PROBATE AND DECEASED ESTATES
We understand how difficult an Estate process of a loved one can be, so our role is to guide you in the legal process, from the reading of the Will and advice to the Executor, contacting asset holders and authorities, gathering asset and financial details, dealing with the Court to obtain a grant of Probate if required, redeeming and selling assets, and finally distributing the Estate in accordance with the Will.

COURT/CRIMINAL MATTERS
If you are charged with a criminal offence or have a crimes family violence/personal safety issue, you have the right to present an effective defence. That is where our team of Lawyers can help.
